SC bench hearing petition against decision on nullifying trial of civilians in military courts dissolved

ISLAMABAD: Supreme Court (SC) bench hearing the petition against the decision on nullifying trial of civilians in military courts stands dissolved and SC has sent the matter to judges committee for constitution of bench afresh. The petitions raising objections on bench were accepted. A six members bench of SC headed by Justice Amin ud Din and comprising Justice Muhammad Ali Mazhar, justice Hassan Azhar Rizvi, Justice Shahid Wahid, Justice Musarrat Hilali and Justice Irfan Saadat Khan took up the case for hearing Wednesday, At the inception of hearing Attorney General (AG) Mansoor Awan told the court 20 accused who were released on the occasion of Eid have gone to their homes. The details who have been set free has been filed through miscellaneous petition. Justice Mian Muhammad Ali Mazhar inquired is there no case now against those who have been released. Aitzaz Ahsan while standing on his seat replied these accused have been sent to their homes after they were convicted. One child was convicted with out trial. He is now hiding himself. What has all this been done it has been done without any discipline. The perfection which AG holds has not been seen in this case. Justice Amin ud Din inquired is he in the list filed by AG about whom you are talking. Aitzaz Ahsan told he is included in this list. The court later made the statement of AG part of record. Khawaja Ahmad Hussain counsel for petitioner Justice (Retd) Jawad S Khawaja while raising objection on bench said the matter for constitution of 9-member bench be sent to judges committee again. Aitzaz Ahsan and other lawyers requested the court to bring the decision on record. The lawyers took the plea the decisions which have been announced to the extent of 20 accused be brought on record. The court remarked we seek copies of decisions from them. Justice Shahid Wahid remarked let us know what procedure was adopted in trial. Later the court sought the copies of military courts decisions.
