Islamabad: Supreme Court (SC) has declared Islamabad High Court (IHC) decision for restraining Justice Tariq Mehmood Jahangiri from performing judicial work null and void.

The SC while accepting appeal plea of Justice Tariq Mehmood Jahangiri made it clear no judge can be restrained from judicial work through interim order.

During the hearing of the case Attorney General (AG) took the plea there is no justification in restraining some judge from judicial work through interim order.

As per media report the petitioner Mian Dawood while agreeing to this plea said he himself has reached the conclusion that it is impossible to defend such order.

Justice Amin ud Din Khan sought opinion directly from Mian Dawood . Upon it he too said he thinks judge cannot be suspended under interim order.

Former AG Munir A Malik too clarified one wrong thing was attributed to him during previous hearing as he had not said that Quo-warranto petition against judge is maintainable.

The court order said that as per AG and arguments of the respondents judge cannot be restrained by interim order.

The court also maintained IHC will have to decide about objections first during hearing of quo-warranto writ.

The SC ordered IHC order for restraining Justice Tariq Jahangiri from performing judicial work is declared null and void and his appeal is accepted.
