SC nullifies IHC decision on matter of allotment of plots to judges, bureaucrats in sector F-14. F-15

Islamabad: Supreme Court (SC) has announced reserved judgment after six months on the matter of allotment of plots to judges and bureaucrats in sector F-14 and F-15 Islamabad.SC while accepting appeal plea of Federal Government Employees Housing Authority (FGEHA) has declared Islamabad High Court (IHC) decision null and void.A 3-member bench of SC presided over by Justice Munib Akhtar had reserved judgment on May 21.Justice Ayesha Malik announced the decision.The decision said IHC should see the matter again and decide in this regard.It is pertinent to mention here IHC had declared Federal Government Employees Housing Scheme (FGEHS) unconstitutional.The court had said in the decision that the state land is not for elite class and it is only for public interest. Judge , bureaucrats and public office holders cannot make policy for personal interest against public interest. Judge and bureaucrats are for the service of people who are real stake holders. FGEHA cannot make any scheme against the constitution.The lHC decision said that housing authority is basic respondent in pending hearing cases in SC and other courts. Was it appropriate to make judges of SC, high court and other courts beneficiary of federal government.Becoming rich by Elite by causing loss to treasury and people is unimaginable in constitutional society.
