SC seeks reply to reply from petitioner during hearing of important legal point about jurisdiction powers of NAB cases

Islamabad: Supreme Court (SC) while seeking reply to reply from the petitioner during hearing of an important legal point related to jurisdiction power of NAB cases has adjourned hearing of the case till July 16.

On not raising objection by NAB on jurisdiction powers Justice Shahid Bilal Hassan remarked jurisdiction power is hindrance first of all which you yourself had removed. Not raising objection on jurisdiction power is incompetence of NAB.

Justice Musarrat Hilali inquired why change has come in the stance of NAB suddenly.

A 3-member bench presided over by Justice Muhammad Ali Mazhar took up the case for hearing Tuesday.

Attorney General (AG) took the plea during the hearing of the case Supreme Court has no jurisdiction powers in NAB cases. Following the amendment in NAB laws, the appeals against bail and sentence will be heard by constitutional court.

AG too said this it is not possible that one part of case is heard by SC and second part by constitutional court.

NAB too supported stance of federal government during hearing of the case.

Ibadul Rehman Lodhi counsel for the petitioner while opposing stance of government and NAB said it has not been written anywhere in NAB amendment that `bail case will be heard by constitutional court.

According to law constitutional court can hear the appeal against sentence.

He told the court SC has granted bail in a case after NAB amendment. NAB had not raised objection over jurisdiction powers of SC in first bail case.

The court questioned from NAB prosecutor had NAB raised objection earlier.

The prosecutor told the court objection was not raised on the jurisdiction powers in March 18 case.

Justice Shahid Bilal Hassan remarked jurisdiction power is hindrance first of all which was removed by you.

The court while directing counsel for the petitioner to make preparations for reply to reply adjourned the hearing of the case till July 16.
