SC sets aside decision of awarding death sentence to a person for killing his mother, orders to release accused

Islamabad: Supreme Court (SC) has set aside decision of high court and district judiciary on awarding death sentence to a person for clubbing his mother to death in the area of Silanwali in Sargodha. .

The court remarked if there is no other case against the accused then he be released immediately.

The court has maintained in the case of murder of mother at the hands of her son this is set legal principle that a single doubt found during investigation of prosecution in criminal cases goes in favor of the accused. It results into release of the accused. Doubts are found in medical testimony and recovery of arms. Therefore, the decision of high court and subordinate court regarding death sentence awarded to son for clubbing her mother to death is declared null and void.

The accused demanded money from mother for drugs. He killed his mother with stick on refusal from her in paying money.

Justice Irfan Saadat Khan has written 11-page decision.

A 3-member bench led by Justice Athar Minallah had given the decision. Now written decision has been issued in the case.

Judge wrote in his decision presence of witnesses already on the scene makes all the matters suspicious. If they were present on the occasion then as to why they did not try to save the lady.
