Special courts will hear the property related cases of overseas Pakistanis: LHC

Lahore: Lahore High Court (LHC) has remarked special courts will conduct hearing of property related cases of overseas Pakistanis.

LHC remarked in its decision powers of special courts are not only restricted to possession and ownership disputes in overseas Pakistanis property cases but all the cases related to property of overseas Pakistanis will also be heard in special court. Cases related to inheritance, mutation , power of attorney, moveable and non moveable property will be heard too by special court.

It has been said in the decision that Overseas Property act is aimed at protecting properties of overseas Pakistanis. Under act the cases of overseas Pakistanis are heard in special courts.

The special court and civil court while misinterpreting the law shifted the cases of moveable properties only. The cases cannot be made ping pong between misinterpretation of civil courts and special courts.

LHC said in its decision even if one party is overseas between the two respondents the case will be heard by special court.

The courts which are transferred from civil courts will run in special courts from that stage. There will be no need to file the cases of overseas Pakistanis afresh.

Special court is special and independent forum in regard to cases related to properties of overseas Pakistanis.

The decision said that the law is aimed at providing speedy and effective justice to Overseas Pakistanis.

Following the enforcement of law, all pending respective cases will stand shifted to special court automatically.

No respondent can be caused harm due to court's mistake or misinterpretation of powers of jurisdiction of court. Only those cases of overseas Pakistanis will not be heard in special court which don't pertain to non moveable property.

The LHC directed all district session judges to ensure implementation of decision.

The court ordered the registrar to send copy of decision to all district and sessions judges.
