Islamabad: Supreme Court (SC) while upholding the decision of converting death sentence into life imprisonment in respect of major convict Khurram Ejaz in Tippu Tarakkan wala murder case has abolished all clauses of terrorism against him.
The court also rejected appeal plea against the acquittal of co-accused Syed Ahsan Shah.
The decision said name of Ahsan Shah was not included in FIR. Therefore, the decision of his acquittal by giving him benefit of doubt is correct.
Justice Ishtiaq Ibrahim while issuing 9-page detailed decision maintained Tippu Tarakkan wala case is not terrorism but it is case of personal enmity. Mere murder on public place does not fall in terrorism.
According to SC prosecution failed in proving solid motive behind murder of the victim while death penalty cannot be awarded under law if the cause is not proved.
In May 2011 anti terrorism court had awarded death sentence two time to the prime accused Khurram Ejaz while Lahore High Court had commuted death sentence to life imprisonment in October 2019 besides acquitting Ahsan Shah.
