Lahore: Justice Malik Muhammad Owais Khalid of Lahore High Court (LHC) has remarked woman can file case of khulla and haq mehr (dower) in the family court of the district where she is residing.He gave these remarks while clarifying a key legal point regarding hearing of family cases and transfer of these cases.Justice Malik Muhammad Awais Khalid issued 6-page detailed decision on the petition filed by lady petitioner Ayesha Nasir.It was said in the decision allowing woman to file case near her residence is tantamount to ease legal proceedings for her.During the hearing of the case the petitioner Ayesha Khalid requested the court that her family case be shifted from family court of Jaranwala to Lahore.The petitioner took the plea in the petition her husband Aun Abbas has filed case in family court of Jaranwala in the area of Faisalabad.She said separate case related to child maintenance is already pending hearing in family court Lahore. Due to it she has to appear in two different cities which is v ery difficult for her.The court while approving plea of the woman allowed to shift case to Lahore.Sahibzada Muzaffar advocate gave arguments in the court on behalf of the petitioner.
