Hague based PCA accepts Pakistan’s position

Hague: The Hague based Permanent Court of Arbitration (PCA) has accepted Pakistan’s position that it had competence to determine a dispute between India and Pakistan regarding change of designs in Kishan Ganga and Ratle Hydro Electric plants by India.

The court of arbitration rejected India’s objection to the assumption of jurisdiction by the international forum - PCA. Now the international court will start hearing Pakistan’s claim on merit to the effect that above mentioned two projects’ designs are in breach of Indus Water Treaty of 1961.

Pakistan was represented by a team of international experts assisted by a team of the Attorney General for Pakistan including Advocate Zohair Waheed and Advocate Ms. Leena Nishter. Barrister Ahmed Irfan Aslam acted as Pakistan’s agent in the PCA.

Ex-CM Punjab Chaudhry Parvez Elahi finally arrested from Lahore by anti-corruption establishment Punjab officials

LAHORE : Pakistan Tehreek-e-Insaf (PTI) President and former chief minister Punjab Parvez Elahi was finally arrested by anti-corruption establishment (ACE) Punjab officials from Lahore outside his home on Thursday.

The former Punjab chief minister was taken into custody by the anti-corruption personnel after pulling over his car near Zahoor Elahi's residence in Lahore’s Gulberg area. Parvez Elahi's Spokesperson Iqbal Chaudhry has confirmed the development.

The development came after an anti-corruption court last week discarded his interim bail over his failure to appear before the court citing health issues. His arrest was required in the Rs70 million corruption case related to the embezzlement of development funds allocated for the Gujrat district.

The anti-corruption court Gujranwala judge also declared Elahi's medical certificate bogus which claimed that he had been experiencing chest pain.

Elahi had been evading arrest since May 9 — following which several PTI members and leaders have been arrested on allegations of their involvement in vandalism — as authorities continued to visit his house for his arrest in a multiple times.

On May 26, a district court in Lahore had issued a non-bailable arrest warrant for Elahi in a case of embezzlement of development funds.

“The pre-arrest bail of the accused was dismissed due to non-prosecution vide order dated May 25 and he is not appearing before the court and also not joining the investigation. In view of the request of the IO, let non-bailable arrest warrants of accused Chaudhry Pervaiz Elahi be issued for June 2, 2023, ” the court order read.

Caretaker Information Minister Punjab Amir Mir confirmed that Elahi was in his vehicle and "trying to flee" when he was arrested near his residence on Zahoor Elahi Road. "Yes, he has been arrested from the Zahoor Elahi road. He was arrested while trying to flee, " the provincial information minister told a private news channel.

"Several raids were carried out at his residence. He was wanted. Today, out of the blue, a couple of bullet-proof cars came out [of the house]. He was in one of the cars, " he said.

Amir Mir said former Punjab CM had been arrested in a corruption case, adding that he would be shifted to the anti-corruption headquarters shortly. “The area around his house had been cordoned off for last couple of days, ” he added.

At first, he resisted but when the police tried to break the mirrors, he came out of his car, he said. “Talks of human rights violations should be toned down because he is an accused, ” he added. “He will be treated in jails as other accused are treated, ” he said.

Reports said that Parvez Elahi had been under the police’s watch for a number of days and he was detained from his residence in Gulberg. “As the police got the information on his whereabouts, they took robust action and detained him, " reports added.

"There were suspicions of his arrest as he had been scheduled to meet some political leaders today", reports said.

Police had been tracking his location for the last couple of days, reports said. "There is no information on where he will be shifted, " reports added.

"However, police personnel have been deployed at Lahore's anti-corruption directorate, but later he could be transported to Gujranwala for further proceedings, " reports added.

1973 constitution is not meant for SC, it is for all: Justice Qazi Faez Isa

ISLAMABAD: Senior judge of Supreme Court (SC) Qazi Faez Isa has said 1973 constitution is not only for Supreme Court (SC) and the rights of all are enshrined therein.

" we can interpret constitution. When some injustice is done it does not stay for long. Justice Munir sowed the toxic seed of breaking Pakistan, he said this while addressing a ceremony held here with reference to golden jubilee of the constitution here Wednesday.

He said the constitution is not meant for politicians, some people, parliament or judiciary but it is meant for people. Creation of Pakistan was a difficult job but it was done in 1947. But the work of giving constitution to people was not done timely. Election was not held under constituent assembly of 1956. In 1958 one man imposed martial law. In 1962 this government servant made his constitution. Election were held under this constitution in 1965. He could not control the situation despite having full powers.

In 1971 country was dismembered and the reason behind it was a wrong court's decision.

He underlined the allegations were levelled that 1977 elections were not held in transparent manner. Despite it both the rivals sat on negotiating table. The matters were settled among the both parties. The agreement was to be signed but an other person came. He remained imposed on nation for 11 years. Then the court awarded death sentence for Zulfiqar Ali Bhutto. Then referendum and democracy drama was enacted. When referendum is held then turn out remains 98 percent despite the fact that 98 percent polling booths remain vacant in referendum. The general elections are held forcefully and turn out does not go beyond 60 percent.

Court accepts bail plea of Ali Amin Gandapur in case registered in Golra police station

ISLAMABAD: District and Sessions Court Islamabad has accepted bail plea of PTI leader Ali Amin Gandapur in regard to case registered in Golra police station against him.

The court directed Ali Amin to submit two surety bonds against Rs 3 lac each.

Additional Sessions Judge Sikandar Khan announced the reserved judgment regarding acceptance of bail plea of Ali Amin Gandapur on Tuesday.

The investigation officer filed his reply in the court of additional sessions judge Sikandar Khan.

It is pertinent to mention here that the court had reserved judgment on bail before arrest plea in the case registered against Ali Amin Gandapur in Golra Police station during the previous hearing of the case on completion of arguments of Sher Afzal Murawat counsel for Ali Amin and prosecutor Adnan Ali.

LHC reserves judgment on Sheikh Rashid petition regarding appointment of care taker CM

LAHORE: Lahore High Court (LHC) has reserved judgment on Sheikh Rashid petiton regarding appointment of care taker Cheif Minister (CM) Punjab.

The petition filed by Sheikh Rashid regarding appointmnet of care taker CM Punjab came up for hearing before single bench of LHC led by Justice Shahid Karim Monday.

The counsel for federal government said Election Commission (EC) stopped implementation of various decisons of care taker CM Punjab. The final powers for induction of care taker CM lie with EC.

The court remarked if EC is independent and neutal then any care taker CM can do nothing. Had the respondents agreed on one name then the matter would not have gone to EC.

The court reserved judgment on the matter of appointment of care taker CM Punjab.

SC moved for initiating contempt of court proceedings against KP governor

ISLAMABAD: PTI has filed contempt of court petition in Supreme Court (SC) against KP governor for not announcing date to hold general election in KP despite clear orders of apex court.

The petition has been filed by former speaker National Assembly (NA) Asad Qaisar and former speaker KP assembly Mushtaq Ghani.

The petitioners have taken plea in the petition that SC had ordered governor KP to give date for holding general election in the province and federal government to provide facilities.

Despite clear orders of SC, governor KP is not giving date for general election in KP.

Through this petition the SC has been requested to initiate contempt of court proceedings against KP governor.

The contempt of court petition against governor KP has been submitted under article 204 of the constitution.
