Islamabad: The decision of imposing 50 percent additional toll on vehicles without an M-Tag and those with insufficient M-Tag balance has been challenged in Islamabad High Court (IHC).

The petition has been filed BY Yahya Farid Khawaja through Advocate Muhammad Jalal Haider in IHC.

The Ministry of Communications, National High Ways Authority (NHA) and other relevant authorities have been made respondents.

The petitioner took the plea NHA imposed 50 percent additional toll as fine on vehicles without an M-Tag and those with insufficient M-Tag balance through a notification issued on May 30, 2025 which is in conflict with law.

According to petitioner only toll tax can be charged under section 10 of NHA act. Neither any mention is made about imposing penalty on vehicles without an M-Tag nor permission has been given to imposing additional charges on motorists whose M-Tag balance is insufficient in the law.

The petition said this step by NHA is violation of article 4, 18, 24 and 25 of constitution. Therefore, May 30 2025 notification be nullified by declaring it unconstitutional .

The petitioner has requested the court to issue order for returning the amount of additional fine received from people under the notification.

NHA be directed to provide complete details of the procedure regarding M-Tag balances and their use.
