Islamabad: First Federal Constitutional Court (FCC) while issuing its first decision has suspended the Peshawar High Court (PHC) decision and issued stay order against it on the appeal of KP government.

A two members bench of FCC presided over by Justice Hassan Rizvi took up appeal plea of KP government for hearing. The court was requested to suspend PHC decision regarding employer and employee.

Justice Hassan Ali Rizvi remarked during the hearing of the case so much amount will come from where to poor laborer under security head.

Additional Advocate General (AAG) Shah Faisal said My lord this case related to poor laborers. Law is this if any private organization removes laborer from job then it will pay the dues of the laborer.

AAG informed the court if the private organization does not pay the dues then the laborer can file appeal in the respective department. If the decision comes in favor of the laborer then the private organization will deposit the dues under the head of security.

AAG said PHC has abolished the condition of security deposit in connection with appeal of the private organization. PHC decision be suspended and stay order be issued.

The court issued notice to the respective respondents besides issuing stay order against PHC decision.
