FCC rejects the plea for returning the petition of five judges of IHC to SC in judges transfer case

Islamabad: Federal Constitutional Court (FCC) has dismissed the plea for returning the petition of five judges of Islamabad High Court (IHC) to Supreme Court (SC) in judges transfer case.

The petition filed by justice Mohsin Akhtar Kiyani, justice Babar Sattar, Justice Tariq Jahangiri , justice Ejaz Ishaq Khan and justice Saman Rafat Imtiaz said that transferring their intra court appeal to constitutional court falls in the jurisdiction powers of SC constitutionally.

The FCC while rejecting the petition said the appeal plea of judges of IHC is dismissed being not contested.

It is pertinent to mention here this case related to transfer of three judges from other high courts to federal capital. SC had not declared transfer of judges unconstitutional in June. Five judges of IHC had filed intra court appeal against it.

The FCC upheld SC decision by rejecting intra court appeal of the judges and other intra court appeals.

A five members bench of SC had declared the transfer of judges correct in majority decision under article 200 of the constitution.

Like wise appeals of Lahore High Court Bar, other appeals of PTI founder, intra court appeals of Tahir Sarfaraz, Karachi Bar Association, Riasat Ali Azad and Shoaib Shaheen have been dismissed being not contested.

The FCC too rejected the plea for meeting with PTI founder or seeking directives.

Chief Justice Amin ud Din Khan made it clear that court cannot issue such orders. Resort to there for meeting where punishment was awarded.
