Islamabad: Federal Constitutional Court (FCC) while giving a big relief to government in an important decision has restored the clauses of Passport and Immigration rules which were earlier declared null and void.
A two members bench of the court led by Justice Hassan Azhar Rizvi took up the case for hearing.
The legal right for including name of the citizens in Passport Control List (PCL) and making their passport non-functional has come back to the government due to this decision.
The court while suspending previous decision of Lahore High Court (LHC) has admitted government appeal plea for regular hearing.
During the hearing of the case the Additional Attorney General (AAG) Amir Rehman told the court LHC had nullified rule No 3 and 10 of Passport and Immigration. The government has filed appeal against it.
Citing to a specific case he told the court one Farhan a citizen had gone to Iran illegally and he was deported from there. Due to it his name was included in PCL, Passport Control List.
Justice Hassan Azhar Rizvi raised interesting and important questions during the hearing of the case.
He inquired is this case of those people who go outside the country by crossing the border illegally (by putting a donkey).
He further inquired was this man trying to go outside the country on his own or was he involved in the work of sending people to Italy by receiving money from them.
Justice Hassan Azhar Rizvi questioned from FIA what investigation has been completed in this matter so far.
AAG while giving reply to the court said latest information have not been obtained from FIA with reference to this matter so far.
The court issued order for suspending LHC decision after hearing the arguments of the respondents.
The court while sending notices to all respondents adjourned the hearing of the case for indefinite period.
