IHC reserves judgment on maintainability of petition filed against SC powers on dam fund

ISLAMABAD: Islamabad High Court (IHC) has reserved the judgment on the maintainability of the petition filed against Supreme Court (SC) powers in connection with dam fund.

The petition came up for hearing before single bench of IHC led by Chief Justice (CJ) Amir Farooq Tuesday.

The counsel Adnan Iqbal appeared in the court.

During the hearing of the case, CJ remarked " read full notification what is in it.

Adnan Iqbal told current account holder is old registrar.

The court inquired then what is issue therein.

The counsel told the court "we are wanting this that constructing dam is job of executive. How the SC is seeing it. It is violation of article 175 of the constitution.

The court inquired " you say money should not be in judiciary account. This way we too do so. Salary comes in our account.

The counsel told the court so many cases are pending hearing in SC. These should be seen.

The court remarked then what is in it. That matter is going on administratively. SC is executive body too. Or you should say they are spending the money on their homes.

The court observed why did not you file the petition when collection was being made. W hen dam funds were being collected then why did you not raise objection. Now five years have passed. Had there been objection over dam fund it would have been made from state bank. Had state bank made any objection then the account would not have opened.

The counsel said SC has not powers to collect fund this way.

The court reserved judgment on the maintainability of petition or otherwise .
