Monal restaurant case: FCC nullifies former CJP Qazi Faez Isa decision

Islamabad: Federal Constitutional Court (FCC) while reviewing the decision of former Chief Justice of Pakistan (CJP) Qazi Faez Isa in the case related to Monal Restaurant, other hotels located in Margalla Hills National Park and constructions has nullified the previous orders of Supreme Court (SC).

The FCC in its detailed 44-page decision has approved review petitions filed by Metropolitan Corporation Islamabad and CDA.

FCC while nullifying SC August 21, 2024 decision and September 10, 2024 review decision has abolished the demolition order regarding Monal restaurant and other hotels.

According to detailed decision civil court will decide about the disputes related to ownership of the land of restaurant, lease and rent.

The court maintained civil court will take final decision as per law after recording proof and testimony of the respondents.

The SC order for nullifying the lease has also been abolished in the order.

FCC declared that construction projects and administrative matters in Margalla Hills National Park fall in the legal jurisdiction of CDA. '

The court also ordered that the rent amount deposited with wild life management board be deposited in national kitty.

It was made clear in the detailed decision that there is no restriction at all on people recreation and construction of rest houses , hotel or other buildings in national park.

It is incumbent that all such constructions should be in accordance with rules and regulations related to environmental conservation.

The court while directing to club all related cases has directed civil court to decide the cases as per law as soon as possible after hearing respondents and reviewing all testimonies.
