Islamabad: Supreme Court (SC) has approved bail of Afghan citizen Jillat Khan who has married to a Pakistani woman.

The court has remarked two children are there and then what more evidence of marriage is needed.

The court raised the question if the accused had no document then how he was declared Afghan.

A two members bench of SC presided over by Justice Hashim Kakar took up the case for hearing.

The accused was arrested under foreign act.

The state counsel took the plea the nikkah nama of marriage with woman is not available with the accused. This Nikah Nama was got prepared in 2024.,

The counsel for the accused told the court the woman belongs to Mohmand Agency and marriage had taken place in 1993. But Nikah Nama was not got prepared at that time.

The counsel said who gets prepared nikah nama in villages.

The state counsel said the man has neither any evidence for coming to Pakistan nor has any Afghan passport.

Justice Kakar remarked the government had allowed Afghans to come to Pakistan. Ration too was given .

The court noted that high courts had already given order to provide domicile to persons who have married to Pakistani women.

Justice Hashim Kakar inquired two children are there. What more evidence of marriage is needed.

He further remarked if there are no documents in respect of accused then how you declared him Afghan national.

The SC approved bail of Jillat Khan against surety bonds in the sum of Rs 20000.
