SC returns matter of premature retirement of Agriculture deptt employee for re-investigation

Islamabad: Supreme Court (SC) while hearing the petition against premature retirement of Muhammad Nasir employee of Agriculture department Punjab in alleged corruption case has returned the matter to respective department for re-investigation.

A two members bench of SC presided over by Justice Jamal Mandokhail took up the case for hearing.

The court ordered the matter be got reinvestigated from some new officer.

Saqib Bhatti counsel for the petitioner took the plea the petitioner was retired pre-maturely on corruption allegations. Inquiry was not conducted as per law and he was retired prematurely as punishment.

Justice Jamal Mandokhail remarked during the hearing of the case that if corruption is proved then pre-mature retirement is not punishment.

The counsel said that service length is seen while giving decision with reference to government employee.

Justice Jamal Mandokhail said if corruption is proved then service length is not seen.

The counsel for the petitioner requested the learned court should give any decision with reference to corruption.

Justice Muhammad Mazhar Ali said we are returning the case now.

The court inquired from the petitioner if case goes back then he can lose the service as well.

The petitioner said I am ready to face inquiry. '

Justice Jamal Mandokhail said the right to fair trial should be given to every one.
