SC suspends IHC order for restraining Justice Tariq Jahangiri from judicial work

Islamabad: Supreme Court (SC) has suspended the order of Islamabad High Court (IHC) for restraining Justice Tariq Jahangiri from performing judicial work.

SC issued notices to the respondents and allowed Justice Tariq Jahangiri to work.

The SC issued notice to Attorney General Office.

The court also issued notice to the petitioner in high court.

A five members constitutional bench of SC presided over by Justice Amin ud Din Khan heard the case.

The other members of bench are Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Hassan Rizvi and justice Shahid Bilal Hassan.

5 judges of Islamabad High Court (IHC) including Justice Tariq Jahnagiri reached Supreme Court (SC).

Justice Mohsin Akhtar Kiyani, Justice Babar Sattar, Justice Ejaz Ishaq , Justice Saman Rafat Imtiaz too reached SC.

Justice Tariq Mehmood Jahangiri was questioned about the alleged fake degree.

The journalist inquired Karachi university cancelled your degree. Will you go to court.

Justice Jahangiri replied petition has been filed in Sindh High Court (SHC). It is strange that they are revoking degree after 34 years. It has not happened so in the history of world.

During the hearing of the case justice Jamal Khan Mandokhail remarked the case with us is to the extent of interim order of IHC. Meeting of Supreme Judicial Council (SJC) has been summoned on October 18.

Justice Shahid Bilal remarked objections were there on the petition against Justice Jahangiri in registrar office in IHC. How the number was marked on writ petition despite registrar office objections. Counsels from respondents of both sides should come prepared on this question.

Justice Jamal Khan Mandokhail remarked SC has given this decision that one judge cannot be restrained from judicial work.

Munir A Malik counsel for Justice Tariq Jahangiri took the plea there is recent decision of Justice Jamal Khan any judge cannot issue writ against other judge.

Justice Jamal Khan Mandokhail remarked the facts of this case were different of which you are referring to.

Member Islamabad Bar Council Aleem Abbasi informed the court we have too filed petition for becoming respondent in this case.

Justice Jamal Khan inquired were you party in IHC. The major petitioner is Justice Tariq Jahangiri.

The lawyers said Islamabad Bar Council, District Bar Association have filed petitions to become respondents in this case.

Justice Amin ud Din Khan said SC office has its own procedure. The petitions will be fixed before us when number are marked on them

Munir A Malik counsel for Justice Tariq Jahangiri said it happened for the first time in the history of country that two members bench of high court restrained judge of its own high court from judicial work. The set law was ignored in the order of restraining Justice Jahangiri from judicial work.

Munir A Malik further said the norms of justice have not been met in the order for restraining judge from judicial work. Writ was filed in IHC against Justice Tariq Jahangiri on July, 10, 2024. Over one year has passed. The registrar office objections are intact there still.

The counsel for the petitioner said some incidents took place after the writ was filed against Justice Tariq Jahangiri. I will put them before the court. Judges came in IHC through transfer. Five judges filed petition against transfer under 184/3. Judges transfer was declared correct. Appeal against it still pending hearing.

Munir A Malik informed the court the judge against whose transfer the judges resorted to SC , bench of IHC presided over by this judge restrained justice Tariq Jahangiri from judicial work on September 16. The objections are still there on the petition under which Justice Tariq Jahangiri was restrained from judicial work. The other respondent was not heard.

SC constitutional bench adjourned the hearing till tomorrow.
