KARACHI: Sindh High Court (SHC) has admitted for immediate hearing JI petition against the law allowing unelected persons to contest for seats of mayor and chairman.
The court issued notice to election commission and advocate general for June 13.
The JI petition came up for hearing before a 2-member bench of SHC comprising Justice Yousuf Ali Sayeed and Justice Muhammad Abdul Rehman Thursday.
Justice Yousuf Ali Sayeed remarked your case is of immediate nature.
The petitioner had taken the stance in the petition local bodies election were completed under elementary local bodies act-2013. Under this law the candidates for elected chairman/mayor took the oath.
Approval has been given under amendment act to make unelected persons as chairman and mayor. According to spirit of local bodies law mayor should be elected among elected representatives.
It has been said in the petition articles from 90 to 93 and from 129 to 131 of the constitution make clear the structure of federal and provincial governments. Getting elected un-elected persons as mayor/ chairman will be against the spirit of constitution and local bodies laws.
The court was requested to declare illegal May 24 notification issued under the recent amendment.
