ISLAMABAD: Islamabad High Court (IHC) has decided to initiate contempt of court proceedings on the news about former chief judge Gilgit-Baltistan and issued show cause notices to Mir Shakil ur Rehman , Ansar Abbasi and Amir Ghauri in this regard.

A single bench of IHC presided over by the Chief Justice (CJ) IHC Athar Minallah took up the case for hearing Tuesday.,

The court remarked during the hearing that the case prima facie looks fake because when the appeal was filed I and Justice Amir Farooq both were outside the country.

The court while expressing annoyance over Mir Shakil ur Rehman and Ansar Abbasi remarked “ you would have obtained information from our registrar office. What is this. Is it your investigation. We heard the case before election. Khawaja Haris gave no application for decision. He was given the second date of July 31. They would have asked from some lawyer. Could they be granted bail after only one hearing.

The CJ IHC inquired that Mir Shakil ur Rehman should come before us . We summoned you with heavy heart. There is difference between social media and news paper. . Had I not full confidence on the judges I would not have initiated this proceedings. Bid was made to break the trust of people on the court. Unfortunately you have done so.

The court ordered Mir Shakil ur Rehman to read the headline of the News.

The court remarked if you cannot read then Ansar Abbasi should read it.

The court inquired if some one issues affidavit then will you publish it on front page. When appeal was filed I and Justice Amir Farooq Malik were not in the country. Do the judges of this court seek directives from some person. Was this affidavit presented in any court.

The court expressed annoyance over non presence of Rana Shamim in the court.

The court raised the question if some chief justice issues such directives before me I will at once inform the supreme judicial council. The judge Sahb remained mute for three years. This mysterious statement came two days before hearing of the appeal after three years. Criticize us but don’t erect hindrances on the way to justice.

The court inquired from Ansar Abbasi the bench which suspended the sentences was formed under whose directives. You know we suspended the sentences after conducting day to day hearing. You know this was an unconventional thing. This is challenge to all of you . Bring even a bit evidence that my judges got directives from some one. This is challenge to all of you, Bring even a single proof. I will be responsible.

The court inquired from the Attorney General (AG) “ tell what will be consequences if the affidavit proves wrong.

The AG told the court this is a straight criminal act. Brother of Rana Shamim passed away on 6 and he is recording the statement in London on 10. How it happened so before appeals. Its timing will have to be seen.

Ansar Abbasi told the court he discharged his obligation as a journalist.

The court remarked are you only messenger.

The court inquired Mir Shakil ur Rheman should tell if Guardian would publish this news item.

Ansar Abbasi told the court I have done what has been done. Action be not initiated against Chief Editor and Editors.

The court remarked bring the evidence. We will take action against the former chief justice of Pakistan.

Ansar Abbasi said “ what I have done I have done for the honor of the court.

The court remarked is it all respect of court, You have not asked from the registrar office.

Ansar Abbasi said contempt of court proceedings should be done against me but the inquiry into the allegations should also be conducted.

The court remarked “ you should not take the things in political way.

Ansar Abbasi said these allegations have been leveled by former chief judge against the former chief justice of Pakistan.

The court remarked no these allegations are against this court. The allegations are against the head of the bench which is hearing appeal. General impression is this that the affidavit is fake.

The court while issuing show cause notice to Mir Shakil ur Rehman, Ansar Abbasi, Amir Ghauri and former chief judge Gilgit-Baltistan Rana Shamim has ordered written reply be filed within seven days.

The court adjourned the hearing of the case till November 28.
