Lahore: Justice Abid Hussain Chatha of Lahore High Court (LHC) while recusing himself from hearing the petition seeking issuance of notification for appointment of Justice Mansoor Ali Shah as Chief Justice of Pakistan (CJP) has sent back the file to chief justice to LHC.The petition filed by Nadim Shibli advocate came up for hearing before Justice Abid Hussain Chatha of LHC Wednesday.The petitioner has taken stance in the petition that as per constitution the senior most judge of Supreme Court (SC) has to become CJP . Justice Mansoor Ali Shah is the senior most judge of SC at present.Justice Abid Hussain Chatha returned the case file to chief justice of LHC for fixing it before some other bench.It is pertinent to mention here LHC had removed objections on the petition for issuance of notification in connection with appointment of Justice Mansoor Shah as CJP.The petitioner had taken the plea that Prime Minister Shehbaz Sharif and president Asif Ali Zardari are making appointment of Justice Mansoor Ali Shah as CJP controversial.The petitioner had prayed LHC to order for issuing notification for appointment of Justice Mansoor Ali Shah as CJP.The court after removing the objections on petition had ordered for fixing it for hearing .
