Peshawar:Consumer court Peshawar has ordered Easy Paisa digital bank to return Rs 40000 to the plaintiff forth with which was transferred out of his account illegally.
Judge Nasrullah Gandapur of Consumer Court has issued written exparte judgment on the petition filed by the citizen against illegal transaction in his easy paisa account.
The court ordered the bank to pay Rs 25000 as damage for the mental torture and embarrassment suffered by the plaintiff and legal expenses incurred by him.
The government ordered the government to impose further fine of Rs 25000 on bank for its negligence.
According to decision Fahd ur Rehman student of 10th class had filed petition under consumer protection act.
The petitioner told the court he went to bank on February 14 to draw Rs 50000 to meet domestic needs but he found only Rs 11000 lying in his bank account.
According to the petitioner the account history revealed when checked that 3 separate illegal transactions were made from his account.
Fahd ur Rehman took the plea neither he did these transactions nor he had allowed any one to do these transactions.
According to decision the petitioner told the court that his bank account was not hacked by any hacker while no notification of transactions was received from Easy Paisa. He contacted easy paisa help line but no positive help was received from the help line.
No representative of Easy Paisa Bank appeared in the court. Therefore, court conducted exparte proceedings.
The plaintiff presented all documentary proofs, transaction receipts , e-mails and receipts of legal notice in the court in support of his claim.
The court maintained in its decision Easy Paisa Digital Bank has failed in protection of its electronic payment system and safety of funds.
