Karachi: Sindh High Court (SHC) has maintained criminal record of any person does not allow the police for extra-judicial killing.
The court gave these remarks during hearing of matter of killing of a missing person Shah Mir in police encounter.
SHC issued written order on the petition.
According to counsel of the petitioner police killed Shah Mir in fake encounter after taking him into custody.
According to state counsel the man who was killed in police encounter was habitual offender. The challan of the case has been presented in the court.
The court remarked apparently continuation of incidents supports this stance that police encounter is dubious.
As per record the petition was filed on January 15 while the alleged police encounter took place on January 17.
Under article 14 of the constitution of Pakistan safety has been ensured against the violence.
The court made it clear in written order the responsibility of police is to present accused persons in the court instead of awarding punishment on its own. If police is allowed to take such steps then the objective of judicial system will meet failure.
According to decision of SHC investigation into such incidents falls in the jurisdiction of FIA under Torture and Custodial death act. The investigation of the case be shifted to FIA forthwith.
The court ordered FIA should complete the investigation in 30 days as per law. The investigation officer should record the statements of petitioner and other witnesses. Copies of the decision be sent to the respective authorities forthwith.
