SHC orders to issue appointment letter on deceased quota

Karachi: Sindh High Court (SHC) has ordered to issue appointment letter to citizen on deceased quota.

Petition against non provision of employment in Local Bodies department on deceased quota came up for hearing in SHC Saturday.

The court ordered to issue appointment letter to the petitioner within a month.

Not deciding the petition up- till 6 years by the department

is not acceptable.

The counsel took the plea in the court father of the petitioner had died during service in local bodies department. The petitioner Zain Ahmad had filed application for employment against deceased quota in 2020. But no decision has been made on the application so far.

The state counsel told the court the post of junior clerk for which the petitioner has applied for is not vacant.

The court ordered the petitioner had right to seek employment on deceased quota under Sindh Civil Servants Rules. This quota has been abolished following the Supreme Court decision. However it is set principle that the rights which have been created earlier don't stand abolished.

It was further said in the decision that as per decision of federal constitutional court the right to employment is created at the time of death of father.

The change in law later does not affect this right. Under the law the appointment can be made against any appropriate post from grade-1 to grade-11. Providing proper post is responsibility of the department.

The court ordered that the respective department should issue appointment letter against proper vacancy within one month.
